Nudge terms of use
These terms are an agreement between you and QAEM (“we”, “us”) for the Nudge app for iPhone and Android and the free Nudge companion for Windows (“the PC app”), together “Nudge”. By installing or using Nudge you agree to these terms. If you don't agree, please don't use Nudge.
If you got Nudge from the Apple App Store, Apple's Licensed Application End User License Agreement (the “Standard EULA”) also applies, and the section App Store below takes precedence where they differ.
1. What Nudge does
Nudge lets you turn on a Windows PC from your phone with Wake-on-LAN, and shut it down, restart it, put it to sleep, hibernate it or lock it through the PC app. It works on your local network, and with Nudge Pro it also works through your own Tailscale network.
Whether wake works depends on your PC's hardware, its BIOS/UEFI settings, its network adapter and your network. Some PCs, especially ones connected only by Wi-Fi, can't be woken from a full shutdown. We can't guarantee that Nudge will work with every PC or network.
2. Your license
We give you a personal, non-exclusive, non-transferable, revocable license to use Nudge on devices you own or control, for your own personal or internal business use. You may not:
- copy, modify, reverse-engineer or redistribute Nudge, except where the law allows it regardless of this restriction;
- use Nudge to control computers you aren't authorized to control;
- use Nudge in a way that breaks the law or harms others.
Nudge includes open-source components that are licensed under their own terms, such as the Inter and JetBrains Mono fonts under the SIL Open Font License.
3. Nudge Pro
- Nudge Pro is a one-time in-app purchase (no subscription). It unlocks the features described in the app and the store listing, such as unlimited PCs, delayed actions, hibernate and lock, automations, remote access through Tailscale, and groups and bulk actions.
- Apple or Google processes the payment under their terms. Refunds are handled by Apple or Google under their refund policies. We can't issue refunds directly.
- Pro is tied to your Apple or Google account. Use Restore purchase to unlock it on another phone signed in to the same store account.
- We may add, change or improve Pro features over time. We won't remove the core of what you paid for (unlimited PCs and the power actions listed at the time of purchase) without a good reason, such as a change in Windows, iOS or Android that makes a feature impossible.
4. Third-party services
- Tailscale is a separate service you set up and sign in to yourself. Nudge doesn't bundle or configure it, and isn't affiliated with or endorsed by Tailscale Inc. Your use of Tailscale is governed by Tailscale's own terms.
- Apple, Google and RevenueCat handle purchases as described in our privacy policy.
5. Your responsibilities
- Power actions are real. Shutting down, restarting, sleeping or hibernating a PC can close programs. “Force” closes apps without letting them save. Unsaved work may be lost. Make sure the right PC is selected and that nobody is using it, and use the countdown or Cancel when in doubt.
- Automations run on their own. A scheduled shutdown runs at its time whether or not you're watching (with a one-minute warning on the PC that anyone can cancel). Review your automations.
- Security. Only approve phones you trust on your PC, keep your phone locked, and remove phones you no longer use. Anyone holding a paired, unlocked phone can control that PC.
- You're responsible for the settings you change on your PC (for example BIOS/UEFI options, network adapter settings, Windows Fast Startup or the network profile), including the ones the PC app offers to change for you.
6. No warranty
Nudge is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't promise that Nudge will be uninterrupted, error-free, or able to wake or control any particular PC.
7. Limitation of liability
To the fullest extent the law allows, QAEM isn't liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, work, profits or revenue, arising from your use of Nudge, including data lost because a PC was shut down, restarted, put to sleep or hibernated. Our total liability for any claim relating to Nudge is limited to the amount you paid for Nudge Pro, or USD 10 if you paid nothing.
Some places don't allow these exclusions or limits, so they may not fully apply to you. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.
8. Ending these terms
You can stop using Nudge at any time by deleting the app and uninstalling the PC app. We may end your license if you break these terms. Sections 5 to 9 continue after these terms end.
9. Changes and general terms
- We may update these terms. We'll post the new version on this page with a new effective date. If you keep using Nudge after a change, the new terms apply.
- If a part of these terms can't be enforced, the rest still applies.
App Store
If you downloaded Nudge from the Apple App Store:
- These terms are between you and QAEM only, not Apple. Apple isn't responsible for Nudge or its content.
- Apple has no obligation to provide maintenance or support for Nudge.
- If Nudge fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for Nudge.
- Apple isn't responsible for handling any claims about Nudge, including product liability claims, claims that Nudge fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If someone claims Nudge infringes their intellectual property, QAEM, not Apple, is responsible for investigating and handling that claim.
- You confirm that you aren't located in a country subject to a U.S. Government embargo or listed as a “terrorist supporting” country, and that you aren't on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
